These Terms & Conditions (“Terms”) govern access to and use of the DOMEX website, mobile applications, controllers, smart devices, and cloud platform (PCC – Professional Cloud Configuration) (collectively: the “Services”), operated by Media Tech Smart Control Ltd., Company No. 514010016, Flamingo 4, Be’er Yaakov, Israel (“DOMEX”, “Company”, “we”, “us”). By installing, accessing, or using the Services you agree to these Terms.
1. Service Description
DOMEX provides smart automation systems allowing monitoring and control of lighting, climate, shutters, boiler heating, automation scenes and integrations with third-party platforms. The Services include the mobile application, the cloud configuration platform (PCC), controllers and smart switches, and remote access and diagnostics.
The system is designed for convenience and comfort only and is not a safety, emergency, medical, security alarm, or monitoring service.
2. User Eligibility
You must be at least 18 years old to use the Services. If the system is installed in a property owned by another party, you confirm you are authorized to use and control the system.
3. Accounts & Access
Users may be assigned login credentials and a CloudID. You agree to:
- Keep login credentials confidential
- Not share access without authorization
- Notify us of unauthorized access
DOMEX is not responsible for damages caused by unauthorized access due to user negligence.
4. Installation & Installers
DOMEX products must be installed by a qualified installer. Installers and integrators are independent contractors and not employees or agents of DOMEX. DOMEX is not responsible for:
- Wiring errors
- Electrical faults
- Incorrect configuration
- Third-party programming changes
- Network infrastructure issues
5. Remote Access & Support
Authorized installers and DOMEX support may access system configuration and diagnostic data when required for maintenance and troubleshooting. We do not monitor user behavior beyond the technical requirements of operating and maintaining the system.
6. Internet & System Dependency
Service availability depends on electricity supply, internet connection, local network and third-party services. DOMEX does not guarantee uninterrupted operation. Automation actions may fail due to external conditions outside our control.
7. Third-Party Integrations
DOMEX may integrate with external platforms (voice assistants, building automation, HVAC gateways, etc.). DOMEX is not responsible for third-party outages, API changes, external service failures, or compatibility changes. Use of third-party services is governed by their own terms.
8. Software License
DOMEX grants a limited, non-exclusive, non-transferable license to use the software only with genuine DOMEX hardware. You may not reverse engineer firmware, copy software, emulate devices, circumvent protections, or resell cloud access. All intellectual property remains the property of Media Tech Smart Control Ltd.
9. Updates
We may provide firmware or cloud updates to improve functionality, performance, and security. Some features may change or be discontinued.
10. Warranty Disclaimer
To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE.” DOMEX does not warrant continuous uptime, error-free operation, compatibility with all systems, or prevention of property damage. DOMEX automation should not be relied upon for critical safety functions.
11. Limitation of Liability
To the fullest extent permitted by law, DOMEX shall not be liable for indirect or consequential damages, loss of data, loss of comfort or convenience, property damage caused by automation failure, or failures caused by installers or third-party services. Total liability shall not exceed the purchase price of the specific device causing the claim.
12. Privacy
Use of the Services is subject to the DOMEX Privacy Policy.
13. Termination
We may suspend or terminate access if illegal use is detected, a security risk exists, or these Terms are violated.
14. Changes to Terms
We may update these Terms from time to time. Continued use constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by the laws of the State of Israel. Exclusive jurisdiction: competent courts in Tel Aviv, Israel. Consumers in jurisdictions granting mandatory protections retain those rights.
